Father Roy Bourgeois still a member of the Maryknolls/Bush protesters get $50,000 settlement from state of Iowa

Dear Friends,

I just got off the phone with Roy . He was in meetings with members of his order since 10am this morning. Roy is feeling happy with the outcome and ecstatic that he is still very much a part of Maryknoll.

Here is what came out of the meeting between Roy and his superiors.

1.) An investigation has been carried out to the the true facts of the August 9th events in Lexington, KY. A report will be sent to the Congregation of the Doctrine of the Faith.

2.) Fr. Roy Bourgeois has received a Canonical warning not to participate in similar ceremonies in the future.

3.) Going forward, the Maryknoll Society leadership and Fr. Bourgeois will be more involved in together in collective discernment over issue of justice including the role of women in the Church.

Roy thanks everyone for all of their support and looks forward to being home in Columbus tomorrow night.

DES MOINES Two retired school teachers who said they were handcuffed and strip-searched during a 2004 campaign stop by President Bush in Cedar Rapids were awarded a $50,000 state judgment, records indicate.

The State Appeal Board recently approved a $50,000 out-of-court settlement for Alice McCabe and Christine Nelson, who brought a claim against the state Department of Public Safety after two state troopers arrested them at a rally at Noelridge Park in Cedar Rapids on Sept. 3, 2004.

The charges were later dropped and the women were awarded $750,000 by a federal jury in U.S. District Court of Northern Iowa last June. Before that trial, the Iowa Attorney General's Office, which represented two state troopers named in the lawsuit, confirmed a state settlement had been reached but declined to offer details.

The settlement payout was included in a State Appeal Board preliminary report that detailed more than $9.1 million in settlements and judgments the panel approved during fiscal 2008.

Authorities had contended that the two President Bush campaign protesters were arrested because they refused to obey reasonable security restrictions at the Cedar Rapids rally, but McCabe and Nelson argued successfully that their constitutional rights to free speech, assembly and freedom from unreasonable arrest and search were violated during the 2004 incident.
